01 //Acceptance of Terms

By accessing and using Brightmark's AI-powered missed call text-back service, you accept and agree to be bound by the terms and provision of this agreement.

02 //Service Description

Brightmark provides an AI-powered lead recovery system that automatically responds to missed calls, qualifies leads, and schedules appointments. Our service includes:

  • > AI text-back responses to missed calls
  • > Lead qualification and scoring
  • > Calendar integration and appointment scheduling
  • > Analytics and reporting dashboard
  • > Voice agent capabilities (where applicable)

03 //User Responsibilities

You agree to:

  • > Provide accurate and complete information when setting up your account
  • > Use the service in compliance with all applicable laws and regulations
  • > Obtain proper consent for SMS/text communications as required by TCPA
  • > Not use the service for spam, harassment, or illegal activities
  • > Maintain the security of your account credentials

04 //Payment & Usage Terms

Service fees are billed according to your selected plan. All fees are non-refundable except as expressly provided in our 30-day money-back guarantee.

FAIR USE POLICY ("UNLIMITED" PLANS)

"Unlimited" plans are subject to a Fair Use Policy to prevent abuse. We define "Fair Use" as up to 2,500 missed call events per month, which covers 99% of standard business operations. Usage significantly exceeding this threshold consistently may be subject to review, surcharges, or transition to an Enterprise plan.

05 //Data Privacy

Your use of Brightmark is also governed by our Privacy Policy. We collect and process data necessary to provide our lead recovery services, including phone numbers, conversation data, and appointment information.

06 //Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We will provide notice of scheduled maintenance and work to minimize service disruptions.

07 //Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will cease immediately. Outstanding fees will remain due.

08 //Limitation of Liability

Brightmark's liability is limited to the amount paid for the service in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages.
